Police say Lindsay Lohan assaulted in NYC hotel

Updated 1 p.m. ET: Lindsay Lohan was assaulted in her Manhattan hotel room early Sunday morning by a man she met at a night club, police sources said.

According to law enforcement officials, Lohan told police she got into an argument with a 25-year-old man she brought to her room after meeting him at 1 Oak in Chelsea.

The argument was allegedly over photos the man took of Lohan on his cell phone while they were in her 15th floor room at the W Hotel near Union Square with some of Lohan's friends.

Police have identified the man as Christian LaBella of California. He was?charged with third-degree assault and harassment. In police paperwork, LaBella listed his employer's work phone as the Washington?offices of Rep. John Shimkus, R-Ill.

Steven Tomaszewski, a representative for the congressman, said in a statement, "While no one from Congressman Shimkus' office has been contacted by Mr. LaBella following his arrest, he has been an employee in the Congressman's Washington office.? Obviously, the Congressman does not condone his actions.? As this is a legal matter for Mr. LaBella, the Congressman nor his office will make further comment."

Lohan told detectives she saw photos of her on LaBella's phone, confronted him about them and took his phone. LaBella then threw her on the bed causing scratches on her hands, police sources said.

Lohan ran out of the room and down the stairs of the hotel, but at some point decided to head back upstairs to her room. When LaBella saw her again, Lohan told police he attacked her, choking her, throwing her to the ground, and climbing on top of her.

A friend of Lohan's who was with her at the time was able to pull LaBella off of her, and Lohan then pulled the fire alarm for help. LaBella took off down the stairs, but police arrived before he was able to leave the hotel and took him into custody.

"Lindsay was assaulted early this morning in a New York hotel," Lohan's rep Steve Honig told E! News. "While she did sustain some injuries, she was not hospitalized. The assailant was arrested and is currently in police custody. Lindsay has spoken with police and is fully cooperating with the investigation."

Also at 10:00 AM ET we get Construction Spending for October. There's also going to be a monetary policy speech by Bernanke, a speech by the head of the SF Fed. At the Value Investing Congress, Bill Ackman, Whitney Tilson, and other swill present picks.

TUESDAY: In the US we get September Auto & Truck Sales, which should provide a critical gauge of the state of the jobs market. The Aussie Central Bank will also act. And we get the New York ISM report. It's also the second day of the Value Investing Congress, so more potentially market-moving picks from hedgies.

WEDNESDAY: We get our first big preview of Friday's non-farm payrolls report, with the ADP jobs report, coming out at 9:15 AM ET. It's also non-manufacturing PMI day, so we'll get numbers from China, Europe, and the US. Wednesday night of course is also the night of the first debate between Romney and Obama. Everyone will be watching.

THURSDAY: The all-important Initial Claims number comes out at 8:30 AM ET. In Europe, there will be rate decisions from the BoE and the ECB (the press conference should be most interesting), and there will be bond auctions in Spain and France. Later in the day, there will be a speech from Fed Governor Bullard.

FRIDAY: The week ends with the Grande Finale of economic data: The September Jobs Report. This needs no hyping of course. Also at 3 PM ET that day, August Consumer Credit is revealed.

As we said: Get some rest. This is going to be big.

Iran accuses IAEA of passing nuclear secrets to Israel

DUBAI (Reuters) - A senior Iranian lawmaker accused the UN nuclear watchdog on Sunday of passing confidential details of Iran's atomic work to Israel, and a military commander said Tehran may consider a pre-emptive strike on the Jewish state if it looked set to attack.

Javad Jahangirzadeh, a member of parliament's presiding board, said International Atomic Energy Agency chief Yukiya Amano had made "repeated trips" to Israel, divulging sensitive information about what Tehran says is its peaceful nuclear program.

"Amano's repeated trips to Tel Aviv and asking the Israeli officials' views about Iran's nuclear activities indicates that Iran's nuclear information has been disclosed to the Zionist regime and other enemies of the Islamic Republic," Jahangirzadeh was quoted as saying by Iran's English-language Press TV.

The IAEA declined to comment. Records show Amano has made only one visit to Israel in his capacity as IAEA chief, in August 2010. He visited Tehran in May this year.

"If the agency's actions lead to Iran cutting cooperation with this international body, all responsibility will be with the IAEA director general," said Jahangirzadeh, also a member of parliament's national security and foreign policy committee.

After weeks of increased hints by Prime Minister Benjamin Netanyahu that Israel could strike Iran's nuclear sites, prompting speculation that might happen before U.S. elections in November, an Iranian military commander said Iran could strike first if sure Israel were poised to attack.

"Iran will not start any war but it could launch a pre-emptive attack if it was sure that the enemies are putting the final touches to attack it," Iran's state-run Arabic language Al-Alam television quoted Amir Ali Hajizadeh, a brigadier general in the Islamic Revolutionary Guard Corps, as saying.

While Hajizadeh's comments might be seen as part of the usual hawkish rhetoric from the Iranian military, the politician's accusation against the IAEA's Amano suggest Tehran's relations with the agency are severely strained.

Last week, Iranian nuclear energy chief Fereydoun Abbasi-Davani said "terrorists" might have infiltrated the Vienna-based agency.

He suggested the IAEA included too much sensitive information about Iran's nuclear program in its reports that he said could be used by saboteurs.

Western diplomats dismissed his allegations as an attempt to distract attention away from the agency's bid to gain access to a site in Iran it suspects was used for nuclear weapons research, something Tehran denies.

Iran blames Israel and its Western allies for the assassination of nuclear scientists in Iran, including an unsuccessful attempt on Abbasi-Davani in November 2010. It also blames those countries for computer viruses that appeared designed to damage its nuclear machinery.

The 35-nation board of the agency censured Iran earlier this month for defying international demands to curb uranium enrichment and failing to address mounting disquiet about its suspected research into atomic bombs.

The resolution prompted Iran's Parliament Speaker, Ali Larijani, to cast doubt on the benefit of Iran's membership in the Nuclear Non-Proliferation Treaty (NPT), the Tehran Times reported.

In another allegation of underhand behavior against Iran, the head of parliament's national security and foreign policy committee said German engineering company Siemens had planted explosives in equipment it sold to Iran for use in its nuclear program.

Siemens, which was building a nuclear power station in Iran before the Islamic Revolution that toppled the shah in 1979, denied Alaeddin Boroujerdi's accusation.

"Siemens does not have any business ties with Iran's nuclear program and does not supply any technical equipment for it," a spokesman for the Munich-based multinational said.

Dog given up during Hurricane Katrina turns up in NC

A 15-year-old white poodle named Shorty was separated from his original owners in Louisiana in the aftermath of Hurricane Katrina.

A dog given up in the aftermath of Hurricane Katrina seven years ago has been found wandering along a road in North Carolina, and its original owners in Louisiana say they want him back.

The 15-year-old white poodle named Shorty has a microchip and staff at the Cabarrus Animal Hospital?in Kannapolis, N.C., were able to trace it to its family in New Orleans.

The family apparently gave up Shorty to a caretaker during or shortly after Katrina struck Louisiana in late August of 2005, flooding much of New Orleans after levees failed, said Dr. Blake Peurifoy, a veterinarian at Cabarrus Animal Hospital who has been treating the dog.

?They (the owners) were hit really hard during Katrina. They lost their home and didn?t have the ability to take care of their dog so they gave it away. They don?t know where it went from there,? Peurifoy told NBC News on Sunday.

The story of the dog?s discovery was first reported by News14 Carolina.?

It?s unclear how Shorty eventually ended up in Kannapolis, a city in Cabarrus County about 25 miles northeast of Charlotte and about 735 miles northeast of New Orleans. It?s also not known how long the dog has been on its own.

WCNC said a teenager in Concord, N.C., called the station on Sunday upon hearing about the dog in the news. The teen said his family had been taking care of the dog for the past several years, according to the TV station. The dog became lost earlier this month and the family has been looking for it ever since, the caller said.

A passer-by going to work spotted the dog wandering along a street in Cabarrus County about two weeks ago, Peurifoy said.

?The gentleman said it was walking in the middle of street. He dropped it off and asked if we could take care of it.?

The approximately 15-pound dog looked in sad shape, its eyes infected and its fur soiled, matted and crusted from head to toe. ?We cleaned him and clipped him up, gave him a bath and turned him back into a white dog,? Peurifoy said.

Staff at the animal hospital then contacted the original owners.

?Apparently they were ecstatic about the dog. They were crying and really happy, really interested in getting the dog back whether he lives another three months or three years,? Peurifoy said.

Veterinarians estimate it?ll be about two weeks before Shorty is healthy enough to be released. Peurifoy said Shorty needs surgery for severe dental disease and also has a heart murmur.

The hospital is treating Shorty free of charge but is hoping someone will volunteer to help transport Shorty back to Louisiana.?

Pump prices fall; oil prices up slightly

The average price for gas dropped about 4 cents since last Friday, the biggest weekly decline in about three months.

Analysts say motorists should see further declines through autumn. But they warn that the decreases will happen slowly because of ongoing supply issues in some regions of the country.

Auto club AAA says the national average fell about a penny overnight to $3.833 per gallon. That's still nearly 12 cents more than a month ago.

Meanwhile, oil rose slightly, but is still headed for its biggest weekly decline since late June. Traders are uncertain about the global economy and oil demand has weakened while supplies are plentiful. Benchmark oil rose 73 cents to $93.16 in New York.

Bolivian VP and journalist marry in Aymara rites

(AP) ? The nation's vice president and his bride chose for their Saturday nuptials a temple of stone walls that the ancient Aymara people constructed some 3,000 years ago to observe the heavens.

The unusual ceremony uniting 49-year-old Vice President Alvaro Garica with Claudia Fernandez, a 25-year-old journalist, was held at an ancestral site honoring the Pachamama, or Mother Earth, in a place called Tiwanaku, about 70 kilometers west of the Bolivian capital of La Paz.

Crews from two television channels provided coverage of the ceremony attended by about 200 people, including Bolivian President Evo Morales, Nobel peace laureates Rigoberta Menchu of Guatemala and Adolfo Perez Esquivel of Argentina, government ministers, ambassadors and Aymara dignitaries.

A pair of shamans bathed the couple in incense smoke and asked the Pachamama and other Andean gods to produce good omens for the pair at the archaeological site located near Lake Titicaca.

In a modern touch, the bride wore a full-length white bridal gown by a French designer. They planned to celebrate a more traditional wedding ceremony Sunday at a Roman Catholic Church.

Although Garcia is not of indigenous origin, Bolivia's president is and often refers to his Aymara roots. Although it has become increasingly popular for non-indigenous Bolivians to make offerings to the Pachamama, a full Aymara wedding is quite unusual, even for indigenous couples.

A federal watchdog agency is investigating the case of two neurosurgeons at the University of California at Davis whose patients died while undergoing an experimental treatment for brain cancer, leading the doctors to be?barred from conducting research?on human subjects. The university confirmed this week that the Centers for Medicare and Medicaid Services, an agency in the U.S. Department of Health and Human Services, had asked the state to review the care of the physicians? patients, according to?The Sacramento Bee.?The doctors introduced bacteria into three consenting patients? open head wounds, theorizing that the subsequent infections would trigger an immune response to fight the cancer. Two of the patients developed sepsis and died within weeks, and the third died months afterward. A university spokeswoman said the findings of the inquiry, by the California Department of Public Health, are expected in about a month.

Years of U.S. fines over Iran loom for foreign banks

LONDON/FRANKFURT (Reuters) - For years, the United States struggled to get foreign bankers to comply with its effort to throttle Iran's economy - but a couple of billion dollars in fines, not to mention lurid headlines and talk of jail time, has suddenly got their attention.

A half-hearted shuffling forward to settle years-old claims of busting U.S. sanctions on Tehran is becoming a stampede since Washington tightened rules to punish Iran's nuclear program and a new aggression among regulators so alarmed many banks that shareholders will be paying out billions more for years to come.

Deutsche Bank and Italy's Intesa San Paolo are among big names that may soon join the still short list of foreign banks that have so far paid more than $2.3 billion in fines; some still protest their innocence but have regarded the cash as the price of keeping access to the U.S. market - and keeping executives out of court, or even jail.

The drama played out last month between Standard Chartered and the New York state supervisor who threatened to strip the august British institution of its vital Wall Street banking licence was not entirely typical. But StanChart's about-face within days, from vigorously defending past deals with Iranian clients to handing over $340 million - 5 percent of its pretax profit - was illustrative of an industry-wide shift in mindset.

"The acceleration in a sense is coming from (the banks') side defensively," said Michael Malloy, a professor at the University of the Pacific McGeorge School of Law in California.

"The notion being that it would be better to get out in front of this and confront the difficulty and come clean rather than wait for the authorities to ferret you out," said Malloy, who previously worked for the U.S. Treasury.

Clearly, it is not something all boards will shout about; when another British bank, Royal Bank of Scotland , made mention of talks with regulators on U.S. sanctions regulations in its quarterly report last month, it took another two weeks before many investors became aware of the issue via the media.

But, after Standard Chartered and June's record $619-million fine paid by Dutch bank ING , the list of European banks going public with warnings about possible U.S. payouts includes Germany's Commerzbank and HVB, a unit of Italy's Unicredit , as well as HSBC in Britain.

And Chinese banks have become embroiled in the process too, with the New York Times reporting on Wednesday that prosecutors said they had found evidence in their investigations that they, too, may have flouted U.S. sanctions against Iran.

By contrast, U.S. regulators long gave little opportunity to domestic banks to deal with Iran at all, leaving American bankers now little troubled by inquiries into past transactions.

FINED SO FAR

It has taken time to reach this point; since Britain's Lloyds TSB Bank Plc became the first to settle, forfeiting $350 million in January 2009 for masking the origin of payments to evade U.S. sanctions on Iran, Libya and Sudan between 2002 and 2007, others to pay penalties have included Credit Suisse , in December 2009, Barclays , in August 2010, and ABN Amro - now part of RBS.

Yet, as disclosures by the regulator in the Standard Chartered case made clear, bank executives were discussing among themselves the risk of personal criminal liability as long ago as 2006, as they sought to maintain profitable business despite confusion over exactly what was permitted under U.S. sanctions rules which had last been substantially altered in 1997.

Political heat over Iran's nuclear program grew as Tehran defied U.N. resolutions in 2006 and denied Western accusations it was seeking atomic weaponry, but only in late 2008 did the U.S. Treasury ban a key element of non-U.S. banks' business with Iranians, known as "U-turn" transactions, by which they passed dollars for Iranian clients anonymously through the U.S. system.

Since 2009, the U.S. Justice Department (DoJ), the U.S. Treasury Department's Office of Foreign Assets Control (OFAC) and the Manhattan District Attorney's office have clamped down on banks dealing with countries blacklisted by Washington.

The sharp tightening of U.S. sanctions late last year, while not strictly relevant to past conduct, and the heightening of political drama over threats by Washington's ally Israel to bomb Iran's nuclear facilities also seems to have limited bankers' appetite for defending in public their dealings with Tehran, however strong many believe their legal cases would be.

"It is a very intense area of focus," said Michael Zolandz, an attorney with law firm SNR Denton in Washington.

"We're certainly sensing from large international banks ... that the pressure on them to disclose transactional information, to start sharing account data and monitor payments ... is definitely increasing."

"PRICE OF DOING BUSINESS"

The rules for U-turn transactions in particular have long been ambiguous at the least, legal experts say:

"Even after recent settlements there remained a need to clarify how the sanctions regime would be interpreted and enforced, which underlines how much uncertainty there is," said Susannah Cogman, at London law firm Herbert Smith.

But despite that lack of clarity over their previous business dealings with Iran, few Western banks now seem ready to put up much of a fight against the United States government.

"To an extent this is the price of doing business in - and with - the U.S.," said Cogman, an expert on regulatory disputes.

Showing an early willingness to cooperate could also help the banks limit the damage and avoid criminal charges.

"There is also the very real possibility of criminal sanctions," said Malloy at the University of the Pacific. "A showing of good faith and attempt to cooperate once you've been made aware of the problem would protect you in most cases."

Deutsche Bank in 2007 stopped taking on new business with counterparties in Iran, and, in a mark of the sensitivity to the risk to employees of U.S. legal action, a regulatory filing from March this year shows it did not involve any American citizen in either a managerial or operational role in Iranian transactions.

Commerzbank warned last month it faced a financial hit to settle the U.S. probes into violations of sanctions on Iran and other countries, which could exceed provisions.

Also last month, Italy's UniCredit said it was reviewing its German unit HVB to check "historic compliance", adding that the New York County District Attorney's Office, the DOJ and the OFAC were leading an investigation.

French banks BNP Paribas and Credit Agricole are conducting inquiries into U.S. dollar payments to check whether they are in breach of U.S. sanctions, they said late in August.

And Intesa Sanpaolo is still subject to an assessment by the OFAC, which could lead to administrative sanctions, half-year financial statements show. It has no further information on the timing or the size of any possible fine.

Samsung Galaxy S II 4G (Boost Mobile)


The unlocked Samsung Galaxy S II?made its debut more than a year ago. 15 months and all the major carriers later, it's finally arriving on Boost Mobile. 15 months is more like a few years in the smartphone?world, so credit should go to Samsung that it's still an excellent device. Not only that?the Samsung Galaxy S II 4G is actually the best phone in Boost's lineup right now. At $369.99 it's rather pricey up front, but it gets you a powerful dual-core processor, a great display, good call quality, and 4G speeds on Sprint's WiMAX network. Physical Design, Call Quality, and Data Speeds
Lovely as ever, the Galaxy S II measures 5.1 by 2.7 by 0.4 inches (HWD) and weighs 4.8 ounces. It's a large slab, available in either black or white, made entirely of plastic with a lightly textured back panel. Just keep in mind that this is a big phone; I was unable to hold it in one hand and drag down the notifications bar with my thumb. But if you like a large screen, you're in luck: The Galaxy S II has a beautiful, 4.52-inch, 800-by-480 Super AMOLED Plus display. This is lower resolution than the 960-by-540 display on the?EVO Design 4G, but Super AMOLED Plus looks richer.

The Galaxy S II is a quad-band (800/850/1900/2600) CDMA/WiMAX phone that runs on Sprint's 3G and 4G networks. You also get 802.11 a/b/g/n Wi-Fi. Reception is average and call quality is good. Voices sound full, clear, and natural, with plenty of volume in the phone's earpiece. The speakerphone also sounds good but isn't loud enough to use outdoors. Calls made with the phone sound clear, though voices can have a slightly robotic quality. I had no trouble connecting to a?Jawbone Era?Bluetooth headset and calls sounded fine. Samsung uses the powerful Vlingo app for voice dialing here instead of the usual Android option. It allows you to dictate texts messages and issue other commands by voice.

Battery life is good, at 6 hours and 54 minutes of talk time over 3G. But turn on 4G, and that number drops considerably, even when you aren't using the phone. You'll probably only want to connect to 4G when you know you're going to use it.

As we discovered in our testing for the?Fastest Mobile Networks, Sprint has the slowest 3G speeds of all the carriers we tested. That means that all 3G-only Sprint, Boost, and Virgin phones are running at some pretty challenged data speeds. Thankfully, 4G WiMAX support offers the Galaxy S II a nice boost. Unfortunately, WiMAX speeds on the Galaxy S II were not as impressive as the speeds I saw on the EVO Design 4G, Boost's other WiMAX phone.

I didn't have the EVO Design on hand to test against the Galaxy S II, so I used the Clear Spot Voyager?, which runs on the same WiMAX network. AN AMATEUR footballer underwent emergency surgery to remove his kidney after a freak accident mid-game.

Johnstown Youth player Kieran Morgan, 21, ruptured his kidney after a collision with a Ruthin Town player at a match at Heol Kenyon, Johnstown.

The father-of-one, of Brynteg, Wrexham, was rushed to Wrexham Maelor Hospital? where he underwent a three-hour operation to remove his kidney.

He is now in a stable condition after a spell in intensive care.

His mother Karen Morgan told the Leader: ?It was just a freak accident, it?s nobody?s fault.

?Kieran was involved in a tackle for the ball from a corner, which resulted in an unfortunate accident.

?He was in extreme pain at the time, and is still quite poorly but he?s conscious and he can talk.

?He?s now stable and on the mend.?

Kieran, who lives with partner Cassey Jones and their eight-month-old daughter Demi-Leigh, was goalkeeper in the Welsh National League (Wrexham area) reserves and colts game on Saturday when tragedy struck in the second half.

A spokesman for the Welsh Ambulance Service said: ?We were called to a football injury at Heol Kenyon, Johnstown, on Saturday at 4.25pm.

Karen said her son, a former pupil at Ysgol Bryn Offa, who is self-employed and works on the Oswestry pipeline, is looking forward to returning home to his family and dog, Tye.
